FDA issues draft guidance for personalized gene therapies as CMS moves to widen access
Editorial illustration — Press Pass USAThe Food and Drug Administration on Tuesday issued draft guidance to help sponsors develop and seek approval for personalized gene therapies for patients with rare genetic diseases, as the Department of Health and Human Services announced parallel steps with the Centers for Medicare & Medicaid Services to expand patient access.
The guidance, “Individualized Human Genome Editing Products: Considerations for BLA Submission and Postapproval Management,” gives a regulatory framework for Biologics License Applications for individualized genome-editing products. Its central idea is an “Individualized Feature Space”: predefined boundaries for how a product may vary from one patient to another while staying within a single application.
Under the draft, a new variant that falls within those boundaries could be added as a manufacturing change, rather than as a new product, when laboratory testing adequately demonstrates its safety and activity — relying on the clinical evidence behind the approved application together with laboratory data for the new variant. The document is draft guidance, not an approval: it contains nonbinding recommendations, is marked not for implementation, and is open for comment through November 27 under docket FDA-2026-D-11783.
“Families confronting rare genetic diseases deserve more treatment options, no matter how few patients share their diagnosis,” HHS Secretary Robert F. Kennedy Jr. said. Acting FDA Commissioner Kyle Diamantas said the guidance gives sponsors “the regulatory clarity they need to develop therapies tailored to each patient's unique genetic makeup, while maintaining the gold standard science that Americans deserve.”
CMS said a new manufacturer application process will follow in the coming months as part of the access effort, aimed at states joining collective pricing arrangements rather than negotiating alone.
