Federal appeals court rules detained migrants have no constitutional right to bond hearings

The New Orleans-based 5th U.S. Circuit Court of Appeals ruled 10-7 on Friday that the Trump administration is not required under the U.S. Constitution to give detained immigrants a chance to seek release on bond.

The conservative majority decided that the Constitution's Fifth Amendment due-process protections do not require bond hearings for immigration detainees. "To the extent petitioners seek to vindicate a liberty interest to be free from physical restraint in the most abstract sense, they can do so at any moment by agreeing to leave the country," wrote U.S. Circuit Judge Cory Wilson, a Trump appointee.

The ruling binds federal courts in Texas, Louisiana and Mississippi — the states under the 5th Circuit's jurisdiction, which house the nation's largest numbers of immigration detainees. If left to stand, it would eliminate a key avenue for detained migrants there to argue for release.

The decision came in Sosnava Rodriguez v. Vergara, lawsuits brought by three Texas fathers — Ignacio Sosnava Rodriguez, Miguel Angel Gomez Alvarado and Alejandro Villegas Angel — each of whom had lived in the U.S. for at least 14 years and has U.S.-citizen children, according to the Texas Tribune. Federal judges had earlier ordered them released; the full court now reversed those wins, throwing out a July 2-1 panel ruling that required hearings within 90 days.

The U.S. Supreme Court agreed this month to consider whether such hearings are required by statute — though not by the Constitution, the question the 5th Circuit decided Friday.
